Terms of Service

These terms cover using Zaelar — both the source-available engine you can self-host, and Zaelar Cloud, the hosted version we run for you. By creating an account or using Zaelar Cloud, you agree to them.

Who runs Zaelar

Zaelar is currently operated directly, ahead of forming a company — the plan is to incorporate in the United States once Zaelar Cloud is generating real revenue. Billing runs from Spain today, so a charge on your statement may show a Spain origin even though the company being formed is a US one; that's expected, not an error. These Terms will be updated to name the entity once it's registered — until then, "we"/"us" refers to the Zaelar project.

The service

Zaelar is a personal voice-and-text AI agent. Self-hosted, it runs entirely on your own machine with your own API keys, under its Sustainable Use License (see the GitHub repository) — we have no visibility into or responsibility for a self-hosted instance. Zaelar Cloud is a hosted instance we run for you, metered by "Energy" (see Billing below).

Your account

You need a real email address and you're responsible for keeping your password safe — tell us if you think someone else has access to your account. You must be able to legally agree to these terms (an adult, or with a parent/guardian's consent where your local law requires it).

Acceptable use

Use Zaelar for yourself, lawfully. Don't use it to break the law, harm or harass anyone, try to break its security, or resell/share access to your account. We can suspend or close an account that clearly violates this.

Free launch licenses

During the launch we give away a limited number of free Zaelar Cloud licenses. A license is an account with its own hosted agent; the counter on the site shows how many are left. Confirming your email adds a one-time welcome gift of Energy to your account, free. When every license is taken, new sign-ups go to a waitlist (we keep only the email address) and we invite people from it as places open. The gift is one per person — creating accounts to collect it again is a breach of these terms.

Prices, payment & Energy

Zaelar Cloud runs on Energy, which your agent uses as it works (thinking, speaking, searching). You can get it two ways:

• The monthly plan — charged in advance, each month, from the day you subscribe; every paid month adds the plan's Energy to your balance. It renews automatically until you cancel.
• Energy packs — one-off purchases, a single charge each.

Energy you've been granted or bought doesn't expire while your account is open. Prices are shown in euros on the site and at checkout, including any taxes we're required to charge, and the price you see at checkout is the price you pay. Payments are processed by Stripe; we never see or store your card details. After every payment you get an email receipt, and all your receipts are on your account page under Orders & receipts. If a renewal can't be charged we'll email you and retry; if it still fails, the plan ends as described below. We may change prices for the future; a change never applies to a period or a pack you've already paid, and we'll tell subscribers at least 30 days before a new price applies to their plan.

Cancelling the plan & closing your account

Cancel the monthly plan any time from your account page → Manage billing. It stays active until the end of the month you've paid for and is not charged again. When a plan ends (because you cancelled or a renewal couldn't be charged), your agent is paused, not deleted: its memory and data are kept, any Energy you still have stays yours, and subscribing again brings it back. Closing your account is different and immediate: it destroys your agent's hosted instance and everything stored in it, cancels the plan, and can't be undone.

Your right to withdraw (EU/UK consumers)

If you're a consumer in the EU or UK, you normally have 14 days to withdraw from a distance purchase. Because Zaelar Cloud is a digital service that starts as soon as you pay, at checkout you ask us to start it immediately and acknowledge that:

• Energy packs are digital content delivered the moment payment clears, so the right of withdrawal ends once the Energy is in your account.
• For the monthly plan, if you withdraw within 14 days of first subscribing, we refund the month minus the share of the service already provided (the Energy you've used).

To withdraw, email [email protected] within that period with your account email. Outside these cases, payments are not refundable except where the law requires it or where we've made a mistake — if something went wrong with a charge, write to us and we'll sort it out.

Availability

We're an early-stage product. We work to keep Zaelar Cloud reliable, but at this stage we don't promise a specific uptime, and the service can change as we improve it.

Your content, our software

What you say to your agent, and anything it creates for you, is yours. The Zaelar software, brand, and Zaelar Cloud infrastructure are ours (or our licensors', for the third-party parts under their own license). The engine's source is public under the Sustainable Use License: you may self-host and modify it for your own personal or internal use, but not sell it or offer it as a commercial service.

Your data, your instance

Every Zaelar Cloud account runs on its own dedicated machine and its own database — never shared with any other account. We don't monitor, read, or use what you say to your agent or what it remembers for you. The one exception is entirely your choice: if you use the feedback button and check the box to attach your current session's activity, that session's data — and only that session — is sent to us to help diagnose what you reported. No warranty, limited liability

Zaelar Cloud is provided as-is. An AI agent can get things wrong — don't rely on it alone for anything where being wrong would seriously cost you (medical, legal, financial or safety decisions), and double-check anything important it does on your behalf. We work to keep your instance secure (see our Security page), but no online service can guarantee against every possible unauthorized access, and we don't control what happens to your data once it leaves our systems through your own actions (e.g. sharing a result yourself). To the extent the law allows, we're not liable for indirect or consequential damages — including those arising from a security incident — and our liability for anything else is capped at what you paid us in the past 12 months.

Ending this agreement

You can close your account whenever you like. We can suspend or close an account that violates these terms, or stop offering Zaelar Cloud altogether with reasonable notice.

Governing law

These terms are governed by Spanish law. If you're a consumer, you also keep every protection the law of the country where you live gives you, and you can bring a claim in its courts. We'd always rather hear about a problem first: [email protected].

Changes

We may update these terms as the product and the business behind it evolve — the date above always says when. If a change matters to you (anything about what you pay, or what you get for it), we'll email you before it applies, and you can cancel before then. Continuing to use Zaelar Cloud after a change takes effect means you accept it.
